The Jurisprudential Regulations Extracted from Bada’i’ al-Sana’i’ Book, Divorce Chapter

Objectives: The study aims to highlight Imam Al-Kasani’s attention to jurisprudential regulations in his book Bada’i’ Al-Sana’i’, in addition to enriching this science by mentioning new formulas extracted from the divorce chapter in the same book, while clarifying the aim behind such regulations and offering supporting evidence. The study also mentions the most vital applications and exceptions to such regulations.
Methods: The study follows the descriptive approach based on induction, analysis, and deduction, based on the chapter of divorce in Bada’i’ al-Sana’i’ book. The most prominent jurisprudential regulations therein are extracted and analysed by explaining their meaning, applications and exceptions. The study then deduces the evidence that the jurisprudential regulation is based upon.
Results: Jurisprudential regulations are countless and are scattered throughout the books of jurisprudence. In determining the jurisprudential regulations in his book Bada’i’ Al-Sana’i’, Imam Al-Kasani benefited from the jurists of the Hanafi school before him. Moreover, he made a notable effort in establishing unprecedented jurisprudential regulations. Imam Al-Kasani referred to these regulations in the aforementioned book by pointing out the source problem, or by pointedly referring the issue to its jurisprudential origin. This study has resulted in the extraction of thirteen jurisprudential regulations on divorce terms, divorce by number, conditional divorce and the exception in divorce.
Conclusions: The great importance of the book Bada’i’ al-Sana’i lies in its attention to jurisprudential regulations, as represented by those mentioned in this study in the divorce chapter, and in the benefits we reap in the jurisprudential field and in formulating personal status laws.
