Acting Based on the Prevailing and the Common among the Fundamentalists: A Jurisprudential Study

Abstract

Objectives: This study aimed to clarify the importance of applying the most and the majority views in Islamic legislation, and to show the accuracy and greatness of legislation in the Usuli and jurisprudential aspects related to applying the most and majority views in the principles of jurisprudence and to clarify the Usuli opinion about applying them, their importance, controls, and fields, in addition to the juristic branches based on the Usuli difference about applying the most and majority views.

Methods: The study follows the inductive approach about issues in the books of Usul al-Fiqh to clarify the stances and views of the Usuli in each of the research issues with their documentation.

Results: The study reached a number of results, the most important of which are: to apply the most and the majority views in inferring the legal rulings, and that the interests and otherwise are based on the most and majority considering what brings benefit and righteousness, and removes the corruption and harm.

Conclusions: The study has a number of recommendations, the most important of which are obligating the opinion of the majority in the collective jurisprudence issued by reputable jurisprudence councils specialized in the region, judicially and practically, and the urgent need in contemporary issues to apply the most and the majority, and to implement this in practice by holding conferences for scholars from all Islamic countries.
