Abstract

Objectives: The study aims to analyze the extent to which the fatwa authorities use fundamentalist rules in their fatwas related to Friday and congregational prayers during the Corona pandemic.

Methods: The research follows two approaches. The first is a descriptive approach, by presenting several fatwas related to Friday and other congregational prayers issued by fatwa authorities in the Muslim world during the Pandemic. The second is an analytical approach, by analyzing the relevant fatwas related to the research aims and extracting the jurisprudence rules on which they were based.

Results: One of the most important findings of the study is that the content of these rules is fixed in evidence, and it is now decided upon in its parts. Inference with these rules is like inference with Sharia evidence, and that one branch may be covered by more than one fundamental rule in proving the ruling. This makes the Mufti and one who requested the fatwa confident.

Conclusions: The study recommends that the official fatwa institutions should pay attention to the strength of inference and the strength of the conclusion, and realize the wisdom behind the ruling when issuing the fatwa, and not to rush in issuing it.
