التَّخْبِيب وأثره في الفقه الإسلامي والقانون السعودي

استهدفت هذه الدراسة التعرف على التَّخْبِيب وأثره في الفقه الإسلامي والقانون السعودي وبيان خطورته ضد الأفراد والجماعات، وأمن المجتمع واستقراره وتماسكه الأسري، ودوره في انتشار الوحشة والبغضاء والتدابر، والتقاطع بين المسلمين، من خلال تناولها لماهية التَّخْبِيب، ومن ثم بيان حكمه ودليله وحكمة ذلك، ودراسة أركان جريمة التَّخْبِيب، وتوضيح أهم صوره، وما يترتّب عليها من عقوبات في الفقه والقانون السعودي، وكذلك الآثار الفقهية المترتبة عليه. استخدمت الدراسة المنهجَ الاستقرائيَّ التحليليَّ المقارنَ، حيث رجعت إلى المصادر الأصيلة في الفقه الإسلامي، ومختلف المراجع العلميّة والبحثية حتى يكون البحثُ مستوفياً لجميع جوانبه ثم تم عرضُ الآراءِ في المسائل حسب الاتجاهات الفقهية، ونسبة كلّ رأي إلى قائله من أصحاب المذاهب. وكان من أهم النتائج التي توصلت إليها الدراسة، ان التَّخْبِيب محرَّم شرعا، والذي يسعى فيه عليه إثم عظيم، ومن ثم يكون جريمة يعاقب عليها جنائياً، واظهرت ان أهم صور الإجراءات السلوكية للتَّخْبِيب الوشاية والخداع، وبهما يقع الإفساد؛ وبه يقع التفريق بجميع صوره وحالاته، وان الأركان الثلاثة للجريمة اجتمعت في جريمة التَّخْبِيب، وصاحبها يتحمل المسؤولية الجنائية، ومن ثمَّ أهلية العقوبة .
