الملخص

الأهداف: تهدف الدراسة إلى بيان المدلول القانوني لعقد الوعد ببيع البناء على الخريطة في ظل قانون الملكية العقارية الأردني، وتحديد أهم الضمانات التي تكفل حق المشتري إذا أخل البائع في تنفيذ التزاماته.

المنهجية: اعتمدت الدراسة المنهج التحليلي الوصفي، حيث تم دراسة وتحليل النصوص القانونية المتعلقة بالوعد ببيع البناء على الخريطة الواردة في التشريع الأردني، وبيان مدى كفايتها لمواجهة هذا النوع من العقود.

النتائج: توصلت الدراسة إلى أن قانون الملكية العقارية الأردني يخلو من معالجة حقيقية للوعد ببيع البناء على الخريطة، سيما فيما يتعلق بتوفير الوسائل التي تضمن حقوق المشتري إذا أخل البائع بتنفيذ التزاماته أو لحمايته من الآثار التي تترتب على إعسار البائع.

الخلاصة: توصي الدراسة تعديل قانون الملكية العقارية الأردني، وإدراج أحكام قانونية توفر حماية للمشتري على الخريطة، من خلال ضمان تحويل حقوق الأرض، وملكية البناء من طرف البائع لمصلحة المشتري بالموازاة مع التقدم بالبناء والتشييد، مقابل تنفيذ المشتري لالتزامه، وكذلك ضمان حسن التنفيذ وربطها بكفالة بنكية أو صلاحية الحجز على جزء من قيمة البناء وفق آلية قانونية معينة.
