Abstract

Objectives: The aim of this research is to clarify the rules that indicate consideration in conjecture, to clarify the intended meaning, and to deal with it as an applied study. It also aims to work on monitoring the most important applications of the rules indicating consideration in conjecture.

Methods: The study followed a descriptive approach through issues related to rule, rooting and branching. It also followed an analytical approach by addressing rules, analyzing their meanings, and linking them to application.

Results: The study concluded that conjecture must have controls in order for it to be considered. The most prominent of these controls is that conjecture should be derived from the references considered legally, and that the conjecture should not conflict with what is superior to it. The study also concluded that the rules indicating consideration in conjecture have a close relationship with regard to the description of validity in the legal rulings when the elements and conditions are met.

Conclusions: The study recommends expanding the study of the rules of consideration, and coming up with a comprehensive theory.
