حق الدول في البقاء في القانون الدولي وأثره على شروط جهاد الطلب عند المدارس الفقهية القديمة والمعاصرة: دراسة مقارنة

الملخص

الأهداف: يهدف البحث إلى بيان مقصود جهاد الطلب، وحكمه، وصور تحقيقه، وكيفية تطبيقيه في العصر الحالي في ظل حق الدولة في البقاء.

المنهجية: اعتمد البحث على ثلاثة مناهج: الاستقرائي، والوصفي، والمقاصدي المقارن. حيث استقرأ النصوص الشرعية في موضوع جهاد الطلب والقوانين الدولية المتعلقة بحق البقاء، وبين المراد منها كما بين مقصودها وشرح وسائل تحقيق مقصود جهاد الطلب بما يراعي فقه الواقع.

النتائج: إن مقصود جهاد الطلب إدامة الدعوة إلى الله وردع العدو، وحكمه فرض، وصور تحقيقه بوجود جيوش نظامية معدة للدفاع عن الوطن تملك القوة الرادعة. مع مراعاة الدولة المسلمة توظيف القوة الناعمة بما يخدم الدعوة إلى الله ويحمي سيادة الشرع. أما تطبيقه في العصر الحالي في ظل حق البقاء فيتم باستثمار العلاقات الدولية الإيجابية، والاتفاقيات الدولية لضمان حرية الدعوة بما يحقق مقصود جهاد الطلب من إدامة الدعوة مع ضرورة امتلاك القوة الكافية للردع.

الخلاصة: فرضية جهاد الطلب في ضوء المنهج المقاصدي لا تخل بحق الدول في البقاء، وينبغي أن يُفهم حكم جهاد الطلب في ضوء غايته ومقصده: من حماية حرية التدين، واحترام العهود. إنّ الحرب ليست الأداة الوحيدة لتحقيق سياسية الدولة، فهناك أدوات ناعمة كالدعوة والتعليم والمؤسسات الثقافية، وينبغي العمل على تفعيلها وفق المقاصد الشرعية، مستفيدين من الاتفاقيات الدولية المنظمة لحرية التعبد، وحرية الضمير.
