الحماية القانونية لعنوان المصنف الأدبي في القانون الأردني:عناوين كتب تفسير القرآن الكريم نموذجًا: دراسة مقارنة)

يمثل عنوان الكتاب أو المصنف جزءا مهما من المصنف المحمي بقانون حماية حق المؤلف، ويحظى العنوان بأهمية زائدة لكونه يمثل الواجهة الرئيسية للمصنف والذي قد يجذب القارىء. وقد بدأت حركة تأليف الكتب والمصنفات منذ زمن طويل، وكانت حركة نشطة في العديد من المجالات منها الكتب المصنفة في علوم تفسير القرآن الكريم عمرت من خلالها المكتبة العربية والإسلامية بمجموعة كبيرة من المصنفات الإبداعية لغة وفقها، وكان المؤلفون وما زالوا يبدعون في رسم حروف عنوان المصنف الذي تسحر حروفه القارىء وتجذب موسيقاه المستمع مما يستحق معه الحماية كجزء من المصنف وعنوانا له يتوج به المصنف ويشتهر به. ولقد تعددت مواقف التشريعات المختلفة في حماية عنوان المصنف؛ منها ما اشترط صراحة الابتكار أو الأصالة ومنها ما نص على حمايته مضمنا شروط هذا العنوان لذات المصنف الأصلي مكتفيا بألا يكون دالا على موضوع المصنف، وقد اتجه بعض الشراح والفقهاء في حماية عنوان المصنف إلى قواعد المنافسة غير المشروعة، اقترحنا أن تقتصر هذه الحماية على الممارسات التجارية والصناعية كما وجدت لأجلها وأن نكتفِ بقواعد الحماية الطبيعية لحق المؤلف مع تأكيد ضرورة إيلاء هذا الجانب بشيء من التفصيل حمايةً للابداع والابتكار للعمل المتميز.
