الملخص

الأهداف: تناولت هذه الدراسة بعض القواعد الأصولية المتعلقة بالحرام، وتهدف إلى بيان حقيقة القواعد الأصولية المتعلقة بالحرام، وحصراً لأهم القواعد الأصولية المتعلقة بالحرام، وبيان معناها الاجمالي، وبيان لأنواع الحرام، وإبرازدور وأثر القواعد الأصولية في التطبيقات المعاصرة.

المنهجية: اعتمدتُ في دراسةِ هذا البحث المنهجَ الوصفَّي التحليليَّ القائمَ على الاستقراءِ، حيثُ تم جمع المادةِ العلميةِ، وتبويبهِا، وتحليلهِا وفَق أصولِ البحثِ العلميِّ؛ للوصولِ في النهايةِ إلى الحلولِ المناسبةِ التي تتفقُ ومقتضياتِ عصرنِا، ولا تُخالفُ أصولَ شريعتِنا السمحةِ.

النتائج: توصلت الدراسة لعدد من النتائج من ابرزها، بيان حقيقة القواعد الأصولية المتعلقة بالحرام بأنها قضية كليّة أصوليّة متعلقة بالمحرم، وتبين أن القواعد المتعلقة بالحرام غير محصورة في خمسة قواعد تم تناولها في البحث، وتبين بأن للحرام أنواع، وهي: المحرم لأصله، والمحرم لوصفه، وإبراز دور وأثر القواعد الأصولية في التطبيقات المعاصرة.

الخلاصة: إبراز الجانب النظري في الجانب التطبيقي المعاصر في عدد من التطبيقات، وهي: (الإجهاض الاختياري)، و(العمل في شركات التأمين التجاري)، و ( إرث أسهم الشركات المحرمة)، و (شراء العملات بالهامش)، و( تداول الأسهم المختلطة).
