توافق الأصل والاستثناء مع المقاصد الشرعية في أحكام الزواج

يهدف هذا البحث إلى بيان أهمية المقاصد الشرعية، وأنها متحققة في جميع الأحكام الأصلية والاستثنائية. وذلك من خلال بيان المقصود بحكم الأصل في أحكام الزواج في الشريعة الإسلامية و بيان المقصود بحكم الاستثناء في أحكام الزواج في الشريعة الإسلامية و بيان العلاقة بين هذين الحكمين. وقد اقتضت طبيعة هذا البحث استخدام أربعة مناهج هي: المنهج الاستقرائي في تتبع الأحكام الأصلية والاستثنائية في الزواج، والمنهج الوصفي عند تطبيق الأحكام على الواقع، والمنهج التحليلي في تحليل أحكام الأصل والاستثناء، والمنهج الاستنباطي لاستباط أن الأحكام الأصلية والاستثنائية تحقق مقاصد الشارع. وقد توصل الباحث إلى أن الشريعة تراعي الحكم العام والاستثنائي ويتحقق في كل منهما المقصد الشرعي، وأن الأثر المترتب على الحكم العام والاستثنائي هو مراعاة مصلحة المكلف، وكل ذلك يتحقق في أحكام الزواج الأصلية والتبعية. أوصت الدراسة بضرورة الاهتمام بدراسة علم المقاصد للوصول إلى الحكم الشرعي، في أحكام الطلاق، كما أوصت طلبة العلم بدراسة الأصل والاستثناء في أحكام الطلاق وغيرها من أبواب الفقة وربطها بالمقاصد الشرعية.
