الملخص

الأهداف: هدفت هذه الدراسة إلى بيان فلسفة تطور حقوق المرأة على المستوى الدولي، وإلى بيان الأسباب التي أخرت إدماج هذه الحقوق ضمن إطار القانون الدولي، وهدفت الدراسة أيضا الى تحليل الكيفية التي أدرج فيها القانون الدولي منظومة حقوق المرأة في منظومة حقوق الإنسان.

المنهجية: استعانت الدراسة بالمنهج الوصفي التحليلي، حيث تم وصف تطور حقوق المرأة على المستوى الدولي وتحليل الأسباب التي جعلت من منظومة حقوق المرأة في مكانتها الحالية، واستعانت الدراسة بالمنهج التاريخي والذي يقوم على دراسة الخطوات التاريخية لنشوء منظومة حقوق المرأة على المستوى الدولي.

النتائج: توصلت الدراسة الى أن تطور منظومة حقوق المرأة جاء على وتيرة مختلفة من منظومة حقوق الإنسان، وهذا ما أثر على مكانة حقوق المرأة في المجتمع الدولي وعلى المستوى المجتمعات الوطنية. وخلصت الدراسة الى أن إنشاء هيئة الأمم المتحدة ودخول المرأة في المجال العام كان له الأثر الأكبر في إدماج حقوق المرأة في منظومة حقوق الإنسان، وإلى أن منظومة حقوق المرأة تقوم على أساس مبدأ المساواة بين الرجل والمرأة عن طريق القضاء على كافة أشكال التمييز بينهم الى أن نصل الى المساواة الحقيقة والتكافؤ داخل إطار منظومة حقوق الإنسان.

التوصيات: أوصت الدراسة الى ضرورة تعزيز حقوق المرأة على المستوى الوطني بالتعاون مع المجتمع الدولي والجهود الأممية ضمن إطار منظومة حقوق المرأة الدولية عن طريق الانضمام الى الاتفاقيات الدولية المعنية بحقوق المرأة والالتزام بمتطلبات هذه الاتفاقيات وطنيا بشكل مدروس ومناسب لطبيعة المجتمعات المحلية. وأوصت أيضا الى أهمية تواجد العنصر النسائي في مواقع صنع القرار الأممي وخاصة في اللجان القانونية، فإن القانون الدولي لابد من أن يأخذ بعين الاعتبار منظورهن في صياغته.
