الملخص

الأهداف: تسعى الدراسة إلى تبيان ما إذا كانت الحرب في اليمن حربًا أخلاقية وعادلة من خلال تطبيق النظرية المعيارية في العلاقات الدولية، وإلى تطبيق نظرية الحرب العادلة على ما ارتكبه طرفا الصراع (جماعة الحوثي – التحالف العربي) من انتهاكات ضد المدنيين في اليمن.

المنهجية: تختبر الدراسة انتهاكات طرفي الحرب في اليمن من خلال تطبيق اقترابي النظرية المعيارية، على أربع حالات مختارة من مجتمع الدراسة (الحرب في اليمن)، وتطبيق أطراف الحرب لمعايير الحرب العادلة قبل خوض الحرب وأثناءها.

النتائج: توصلت الدراسة إلى أن قوات التحالف وجماعة الحوثي قد خاضت حربًا لا تتبع القواعد الأخلاقية المتعارف عليها دولياً؛ فمن خلال تطبيق النظريتين الأخلاقيتين، نجد أنه قد تم استهداف أهداف مدنية؛ حيث لم تكن هناك أهداف عسكرية قريبة. وقد أسفرت تلك الاستهدافات غالبًا عن عواقب مميتة يشكل العديد منها انتهاكات واضحة للقانون الدولي والقانون الدولي الإنساني.

الخلاصة: وجوب البناء على نقاط القوة في النظرية المعيارية عند دراسة المسؤولية الأخلاقية التي يجب أن يتحلى بها أي طرف في حرب ما، مع الوضع في الاعتبار أن طريقة تطبيق الاقترابات مازالت بحاجة إلى التدقيق حيث تستدعي تفاصيل يتعذر على الباحث الحصول عليها في مناطق الحرب المندلعة؛ أما بالنسبة لنظرية الحرب العادلة فيجب فتح الباب لمزيد من التفصيل لقانون ما بعد الحرب، فهو أمر حتمي عند النظر في كيفية إقامة سلام دائم بين الأعداء الحاليين بمجرد انتهاء الأعمال العدائية.
