The political views of the jurist Tawoos bin Kaysan Al yamani (d.106AH/725 AD ) and his relationship with the Umayyad state

Abstract

Objectives: This study examines the political positions and opinions of the jurist Tawoos bin Kaysan Al-Yamani (d. 106 AH/725 AD), exploring whether his views were unique compared to other Sunni jurists in general and those of the Umayyad state. He often opposed the approaches of the Umayyad governors and caliphs, and his significant statements were derived from his direct interactions with the Umayyad authority.

Methods: The study employs both descriptive and historical approaches. Using the descriptive analytical method, the research problem was described, hypotheses were proposed, and evidence was presented to support or refute these hypotheses. The historical approach reviewed historical narratives and data to outline bin Kaysan’s political vision.

Results: The study found that Imam Tawoos' positions generally aligned with those of other Sunni jurists on political matters, although discrepancies were noted, particularly in his strict stances. While he offered critical political proposals to the Umayyad rulers within the framework of his religious and cultural formation, he did not present a comprehensive political vision. He cannot be classified as a political or revolutionary leader, as he neither participated in revolutionary movements nor engaged in resistance against the Umayyad state.

Conclusions: The study highlights the need for further research into the relationship between scholars and the Umayyad state, particularly their political opinions and varying stances on authority and revolutionary movements during the Umayyad era. It recommends comprehensive studies to create a picture of jurists and their multifaceted roles throughout Islamic history.
